Terms of Service
These Terms of Service ("Terms") govern the use of 123Cart (https://123cart.in) by merchants who create stores and by customers who buy from those stores. By creating an account or placing an order you agree to these Terms.
The service
123Cart provides software to build and host online stores. Each store is operated by an independent merchant who sells their own products. 123Cart is not the seller, does not handle payments between customers and merchants, and is not a party to the sale.
Merchant accounts
- You must give accurate information, keep it up to date and keep your password secure.
- You must verify your email address before setting up a store.
- You must provide a valid contact number and choose WhatsApp or phone calls as your primary contact method before publishing.
- You are responsible for all activity on your account.
Verification
Within the period shown in your dashboard (normally 7 days after you verify your email), you must upload one accepted proof of identity or business. If the deadline passes before your proof is approved, your store cannot take new orders until it is approved. Existing orders are not affected. We may ask for further information if a document is unclear.
Merchant obligations
- Product information, prices, taxes, images and descriptions must be accurate and not misleading.
- You must deliver what you sell, handle returns, refunds, complaints and warranties, and issue invoices as the law requires.
- You must hold the licences and registrations your business needs and comply with all applicable laws, including consumer protection and tax laws.
- You must verify payments in your own UPI or bank app before confirming orders.
Customer data
Merchants may use customer data only to fulfil and support the customer's order and as the law allows. You must keep it confidential and secure, must not sell it, and must not use it for spam or unsolicited messages.
Prohibited activities
You must not use 123Cart for anything prohibited by the Acceptable Use and Anti-Abuse Policy, including fraud, phishing, spam, impersonation, illegal products or services, malware, or attempts to bypass verification or platform controls.
Suspension and termination
We may restrict new orders, suspend or terminate a store or account if these Terms or the Acceptable Use Policy are breached, verification is not completed, we are required to by law, or there is a risk of harm to customers or the platform. Where reasonable we will tell you why and how to appeal. You may close your account at any time by contacting support@123cart.in.
Complaints and disputes
Customers should first contact the merchant about orders, payments and deliveries. Complaints about a store or about 123Cart can be sent to The Grievance Officer at support@123cart.in or through the report form at https://123cart.in/page/report. Disputes are subject to the laws of India and the jurisdiction of the competent courts in India.
Fees
Plan fees and limits are shown in the dashboard. We will give notice before changing the fees of a paid plan.
Indemnity
To the extent permitted by law, merchants agree to indemnify 123Cart against third-party claims arising from their products, their store content, their dealings with customers, or their breach of these Terms or the law.
Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Subject to that, 123Cart is not liable for losses arising from a merchant's products or conduct, or for indirect or consequential losses, and our total liability to a merchant is limited to the fees they paid us in the 12 months before the claim.
Changes
We publish every version of these Terms with its date. If we make material changes, merchants must accept the new version to continue using the dashboard.
